Building Permitting

The City of Flagler Beach is engaged in an inter-local agreement with Flagler County and the Flagler County Building Department to provide building official and building official related services.  The City of Flagler Beach serves only as a processing center.  Building permit applications are submitted and obtained at the City of Flagler Beach as well as the payment of all fees and charges. Click here for information regarding current impact fees.  Building plan review, field inspections, re-inspections and the like, is provided by the Flagler County Building Department.  Specific questions pertaining to building codes and standards information and practices should be directed to:  Gary Hiatt, Chief Building Official of Flagler County. e-mail – ghiatt@fcbcc.org

Florida Statewide Building Code

The State of Florida has adopted a new statewide building code, which became effective on October 1, 2005.  Information on the Statewide Building Code may be found at the Florida Building Commission website.

 

Inspections

Frequently Asked Questions – Building 

 

When is a permit required?

 Any owner, authorized agent, or contractor, who desires to construct, enlarge, alter, repair, move, demolish, or change the occupancy or occupant content of a building or structure, or any outside area being used as part of the building’s designated occupancy (single or mixed) or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by the technical codes, or to cause any such work to be done, shall first make application to the building official and obtain the required permit for the work. 

 

How long does a permit stay active?

 The Statewide Building Code allows for periods of up to six months to lapse without requiring work to proceed on an individual job site.

 

Can a building permit be extended?

 One or more extensions of time for periods of not more than ninety (90) days each may be allowed by the building official for the permit, provided the extension is requested in writing and justifiable cause is demonstrated.

 

As a contractor, what licenses are required to apply for a permit?

 You have to provide a copy of your State License, Workers Compensation Certificate and Flagler County Local Business Tax Receipt  for every application. 

 

When is a Notice of Commencement required?

 This document is required when the value of work exceeds $2,500, or in the case of mechanical work, $5,000.  The Notice of Commencement must be certified and recorded by the Recording Department in the Flagler County Courthouse at 200 East Moody Blvd., Bunnell.

  

When is a Mechanics Lien Affidavit required?

 This document is required, signed by the owner and notarized, when using a contractor and the value of the labor and material is over $2,500 in value.  A stamped envelope addressed to the owner is also required.

 

When is an Owner Builder Disclosure Statement required?

 This document is required when an owner is acting as his/her own contractor.  If property owner is a corporation or an LLC, permits cannot be used as Owner/Builder.

 

How is an inspection requested?

 Inspection requests are made by calling A.I.R.S. (Automated Inspection Request System) at (386) 313-4090.  You will need your permit number, confirmation number and inspection code.  All these numbers can be found on your permit and inspection card.

 

Do the approved building plans have to be on the job site for inspections?

 Yes, posted along with your permit, inspection card and Notice of Commencement.

 

Who is permitted to call for an inspection?

 Whoever is listed as the contractor of record.

 

When is the latest I can schedule an inspection?

12:00 p.m. the previous day.

 

When I call for an inspection, when will it de done?

 The following workday for building inspections.

 

When can power be turned on?

 Once all of the inspections are complete and any outstanding fees have been paid the Building Department (Flagler County) will contact Florida Power and Light to approve final power.

Land Development and Uses 

 

Is the Flagler Beach Code available online?

 Yes, the Code is available at www.municode.com. Follow the links to the Online Library. Flagler Beach has adopted Land Development Regulations as “Appendix A,” however, to date, the Land Development Regulations are contained within the Flagler Beach Code of Ordinances.

 

What are Land Development regulations?

 Land Development Regulations include regulations that pertain to matters such as zoning, development standards, building height, subdivisions, wetlands, land clearing, tree removal, signs, sea turtle lighting, and concurrency management.

 

Are copies of the Future Land Use Map available?

 The FLUM may be purchased at the City Clerk’s Office. The contact number is 386.517.2000.

 

Are copies of the Flood Insurance Rate Map available?

Copies of the FIRM are available to the public through Federal Emergency Management Association.  Click here to go the FEMA website.  They are also available to view in the Building Department.

 

How can I use my property?

The type of use(s) a property owner is permitted depends on the current zoning district classification indicated on the zoning map, and the land use classification prescribed on the Future Land Use Map. Certain districts permit different types of land development and land use activities on a given parcel of land. Please contact the Planning and Zoning Department to determine the principal permitted uses, accessory uses and Special Exception uses allowed on your property. You must provide a complete legal description or property parcel number. The Planning and Zoning Department number is 386.517.2000. 

 

What is zoning classification and land use?

Each property is designated a specific use classification (e.g. single family, commercial, etc.).  The zoning category regulates permitted uses and development criteria for the given zoning category (lot coverage, building setback, etc.). This information is included in the Land Development Regulations. All properties are graphically illustrated on the adopted Official Zoning Map, and may be viewed by the public in the Planning and Zoning Department. Copies of the zoning map can be purchased thru the City Clerk’s Office located in City Hall.

 

Can I obtain a written confirmation of zoning, future land use designation or confirmation of reconfiguring lots of record?

 A written confirmation can be provided upon written request.  A complete legal description of the property in question must be provided. The established fee for this service is $35.00. 

 

How can I change the zoning on my property?

 A property owner may request a zoning classification change. The process involves filing of appropriate application documents, staff review, public notice, a minimum of two public hearings (Planning and Architectural Review Board and approval by the City Commission) and payment of related fees. Fee charges may be obtained at the Planning and Zoning Department.

 

What is the maximum building height?

 The maximum building height is thirty-five (35) feet. The building height measurement is dependent upon the type of roof (flat, mansard, gable etc.) design for the structure(s).

 

Can I build a boathouse, dock private garage or other such structure on my property prior to constructing a house?

 The above structures are categorized as accessory structures and may not be constructed until a building permit has been obtained for the primary structure.

 

Setbacks

 

What is a setback line?

 Established in the Land Development Regulations, it is a line generally parallel to and measured from the property line which defines the yard area in which no building, other than accessory structures may be located above grade, except as otherwise provided in the Land Development Regulations.

 

Where are the required setbacks measured from?

 Setbacks are measured from the property line to the wall or supporting portion of a structure. For those lots that front on the Atlantic Ocean, the established Coastal Construction Line (CCL) is the setback line, unless a permit has been obtained from the Department of Environmental Protection approving construction seaward of the CCL.

 

Are there setback requirements for accessory uses?

 Accessory structures are required to meet minimum setbacks based on the zoning classification. No accessory structure is permitted in a required front yard area. Specific setback requirements for accessory uses can be obtained at the Planning and Zoning Department, 386. 517.2000.

Fences

 

Are there any fence regulations for private property?

 Yes. There are regulations for residential zoning districts and commercial and industrial zoning districts. For residential zoned property, no fence, wall or hedge shall exceed four (4) feet in height in the required front yard area. No fence or wall shall exceed six (6) feet in the side yard or rear yard area. You are urged to contact the Planning and Zoning Department to obtain specific information pertaining to your situation.

Code Enforcement

 

Code Enforcement was developed to promote the health, safety, and welfare of our residents. Code Enforcement Officers enforce a broad range of land use related ordinances.  Enforcement services are initiated primarily in response to citizen complaints.  Residents are encouraged to report alleged violations to the Code Enforcement Department at City Hall by calling 386-517-2000 ext. 241 or by filling out the alleged complaint form provided below.  Return complaint forms to City Hall or send via e-mail (ecowart@cityofflaglerbeach.com).   Should you need to report a code enforcement violations after hours on or the weekend, please contact the police department at (386) 517-2020.

 

Code Enforcement Process 

 

All residents are given time to correct the violation(s).  The length of time given will be determined by the severity of the situation.  If the resident does not bring the property into compliance within the time allowed, a formal notice will be mailed/delivered.  If the violation continues beyond the time allowed in the formal notice they could be brought before the Code Enforcement Board for a hearing.  (This process can take several months.) 

The Code Enforcement Board has the authority to levy a fine up to $250.00 per day for first time violators and up to $500.00 per day for repeat violators.  Failure to pay fines can result in a lien being placed on the property and possible foreclosure.

 

Some Common Code Violations

 

  • Overgrown weeds and grass on property, does not include vacant lots.                                      

  • Storage of junk, garbage and trash on property

  • Vehicle repairs in residential areas

  • Inoperable/unlicensed vehicles stored on property

  • Signage in the right of way

  • Construction without a permit

  • Dilapidated structures/fences

  • Tree removal without a permit

·    No house numbers or numbers are not visible from the right-of-way

 

Frequently Asked Questions - Code Enforcement 

 

I have received a notice from the City’s Code Enforcement Officer for violating one of the City’s codes.  I need more time to correct the problem, what should I do?

 Before the deadline expires, call or go by City Hall and speak with the Code Enforcement Officer.  Based on the circumstances, and, your good faith, the deadline may be extended.

 

What happens when a person who was cited for violating a City ordinance fails to comply?

 If the person in charge of the property has been cited for a violation and has made no effort to comply with the ordinance, the case will be presented to the City’s Code Enforcement Board.  A possible $250.00 administrative fee and a fine up to $250.00 per day ($500.00 per day for repeat violators) may be assessed to the property owner for non-compliance.

 

How high can I let my grass grow before it is considered a violation?

 The accumulation, or untended growth of weeds and grass, not to include natural vegetation, may not exceed twelve (12) inches in height.

 

Can I park my RV in the driveway?

 Resident owned recreation vehicles might by temporarily parked in the residence driveway for the purpose of repair, maintenance or being prepared for use.  However, such temporary parked shall not occur continuously for more than seventy-two (72) hours in any consecutive seven-day period.

 

Where can I store my boat?

 A boat or similar craft is not permitted to project into any required yard area* or encroach into easements, parking areas, or other required areas.  *(front yard 25ft; side yard 10% of width of lot; corner lot 15ft of street side yard; rear yard 10 ft.)

 

When is a building or structure considered a public nuisance?

 When the building or other structure has fallen into such a poor state or repair to the extent and in the manner that they may reasonably become infested or inhabited by rodents, vermin or wild animals, or may threaten or endanger the public health, safety or welfare, or may adversely affect and impair the economic welfare or adjacent property.

 

Are construction sites allowed to have litter and debris all over the lot?

 All debris shall be kept in such a manner as to prevent it from being spread by any means.

 

Are restroom facilities required on a construction site?

 Adequate sanitary facilities for the convenience of all workmen shall be provided. 

 

Can signs be placed on public property or in the city right of way?

 No person shall erect a sign on or over any public property or public right-of-way except by a public body or a semi-public body provided such sign is approved by the Building, Planning and Zoning Director.

 

Where can I store my trash receptacles?

 Except on the day of trash pickup, trash receptacles shall not be stored in yard areas adjacent to any city street.

Local Business Tax Receipt

formerly known as an Occupational License

 

Local Business Tax Receipt: A Local Business Tax Receipt is required for all businesses including approved home occupations.  Local Business Tax Receipt, transfer of business ownership, registration of a businesses, and proof of insurance matters are processed through this Division.

 

Local Business Tax Receipt & Registration

 

Local Business Tax Receipt - A Local Business Tax Receipt is required for all entities conducting business with a City of Flagler Beach address.

 

Local Business Tax Receipt Fee- An annual fee of $50.00 must be paid.  Each license is issued for one year commencing October 1 and valid through September 30th of the following year.

 

License Application Fee - Each new applicant applying for an Occupational License must pay a one-time fee of $45.00

 

Business Registration - A Business Registration is required for anyone conducting business activity within the City of Flagler Beach, with a business address being other than Flagler Beach.  The yearly fee is $25.00 and is valid from Oct.1 thru Sept. 30.  Documents will be kept on file for permitting purposes.

 

Transfer of a Local Business Tax Receipt - Transfer of a Local Business Tax Receipt requires the issue of a  new license.  The fee is $8.00.
